Barbara Boxer Senate campaign has solicited Los Angeles teachers to recruit students as Boxer volunteers

"Barbara Boxer asked LAUSD to violate the law!"

Via Republican Jon Fleischman's "Flash Report" blog, the Howard Jarvis Taxpayers Association has complained to the L.A. school district and board of education that the Barbara Boxer Senate campaign has solicited Los Angeles teachers to recruit students as Boxer volunteers.
http://www.flashreport.org/files/2010102712055409.doc
California unions are waging a get-out-the-vote drive for Boxer, who is gaining on Republican opponent Carly Fiorina in recent polls. It's not clear if students were solicited outside the bounds of state law. This red meat may be aimed at stirring up the GOP base.

The anti-tax group cited a "Dear Teachers" letter on the Boxer campaign letterhead that said, "As you may know, Senator Boxer is facing her toughest race yet," and students will "gain an invaluable educational experience on one of the highest profile Senate races this election...The Boxer campaign needs volunteers...."

The group said the California Education Code prohibits political recruitment of students, citing section 51520:

"During school hours, and within one hour before the time of opening and within one hour after the time of closing of school, pupils of the public school shall not be solicited on school premises by teachers or others to subscribe or contribute to the funds of, to become members of, or to work for, any organization not directly under the control of the school authorities, unless the organization is a nonpartisan, charitable organization organized for charitable purposes by an act of Congress or under the laws of the state, the purpose of the solicitation is nonpartisan and charitable, and the solicitation has been approved by the county board of education or by the governing board of the school district in which the school is located."

Boxer campaign manager Rose Kapolczynski had this explanation: "Because some local social studies teachers encourage students to volunteer, Boxer campaign volunteer coordinators notified a handful of schools near the campaign headquarters that the campaign was accepting volunteers. The letter did not ask teachers to solicit students to work on the campaign or to use school facilities, supplies or equipment for political purposes. The sole intent of the letter was to provide interested students with information about a volunteer opportunity. However, the letter, which was written by a volunteer and reviewed by a junior staffer, was inappropriate and we apologize. The author of the letter has been counseled and campaign coordinators will no longer conduct outreach to public schools."

---------------
Today the Howard Jarvis Taxpayers Association notified the Los Angeles Unified School District and the Los Angeles Board of Education today that, in abject ignorance of California state law, the political campaign of Senator Barbara Boxer has openly solicited teachers employed by LAUSD to urge their students to volunteer for her campaign.

HJTA's letter to the school district urges LAUSD to immediately inform all its personnel, credentialed or otherwise, that it would be a clear violation of law for teachers to recruit their students on school property during school hours to volunteer for a specific political campaign.
Pursuant to both case law and a specific provision of the California Education Code, what Boxer wants would leave LAUSD subject to both civil and potentially criminal sanctions. Common sense should also tell her that seeking public resources and classroom time from teachers to do her political bidding is just wrong. Barbara Boxer should know better.

A copy of the letter was faxed to both the school district and the Board of Education this morning, and is attached below.

Democrats Set Records for Dirtiest Election Ever

2010: Democrats Set Records for Dirtiest Election Ever
Sunday, 24 Oct 2010
By: David A. Patten

"Everything you are seeing on TV is a shameful lie." That statement didn't come from an ad-weary voter, but it certainly could have.

It's actually a quote from GOP state Sen. Mick Mulvaney of South Carolina. The reason for Mulvaney's disgust? Democrats recently aired an ad showing police booking an elderly woman into jail, as a narrator warns seniors that Mulvaney may take away their Social Security.

Mulvaney, running for Congress against Democratic Rep. John Spratt, called the 30-second spot "one of the most offensive and frightening ads I think I've ever seen."

As bad as it is, that ad may not even be the worst of this season's dirty campaign advertising tricks. Just ask Ben Kalasho, who's running for city council in Santee, Calif., northeast of San Diego. One morning he got a call from a voter asking why he was putting up campaign posters in Arabic.

Huh?

According to the local CBS affiliate, someone printed up signs calling Kalasho "The Arab Leader Santee Needs." To drive the attack home the sign displayed some Arabic characters.

"The funny thing," Kalasho said when he learned of the mysterious signs, "is I'm Polish."

Those are just a few examples of the extraordinarily negative tone that political campaigns are striking this year. Faced with an angry electorate and a poisonous anti-incumbent zeitgeist, many Democratic incumbents feel they have no choice but to launch personal attacks against their opponents.

While Republicans have been taking aim at Democrats voting record, including their backing a $787 billion stimulus that failed to produce the promised jobs and a $500 billion cut to Medicare for Seniors, Democrats have gotten mean with ad hominem attacks.

In Florida’s 22nd Congressional District, Democratic Rep. Ron Klein is airing a flurry of commercials saying conservative Republican challenger Allen West didn’t pay his credit card bills and has close ties to a motorcycle gang. West has denied the charges about the motorcycle gang but admitted he did not pay some credit card bills on time. His excuse? He was serving in the U.S. Army in Afghanistan and his family back home was stretched, he says.

In Staten Island, New York Democratic Rep. Michael McMahon is bombarding airwaves with ads saying his Republican challenger, Michael Grimm, lost money speculating in real estate and operated a failed restaurant.

It's a political game played from both sides of the aisle in every election, of course. But there are indications the midterm election of 2010 is emerging as one of the dirtiest races ever with most of the mud flying from Democratic ramparts.

"We always say this is the most negative cycle," Evan Tracey, an analyst who tracks campaign ads for the Northern Virginia-based Campaign Media Analysis Group, tells The Washington Post. "But 2010 probably will be it. The national issues are huge, and both parties hold the view that you have to blow up your opponent."

The Wesleyan Media Project tracked nearly 900,000 advertisements from January through October. Its conclusions: 20 percent of this year's ads attack the personal characteristics of their opponents. That's up from 14 percent in the 2008 campaign, they report.

"The Democrats are wary of trying to brag about anything, given the bad mood and the recession," said Eugene Kiely, an official with the FactCheck.org watchdog. "So they have done relatively few positive ads. "It's been attack from the beginning," he told The Huffington Post.

This cycle, it's no longer just the candidates being targeted with negative advertising, either. In July, Target donated $150,000 to a pro-business organization that gives money to pro-business politicians, both Democrats and Republicans.

MoveOn, which is partially funded by leftist billionaire George Soros, struck back at Target with an ad of its own that stated: "Target and other big corporations are trying to buy our elections." It called for a boycott against Target, stating, "Our democracy is not for sale." Fox News host Bill O'Reilly called the MoveOn attack ad "dirty, dishonest and disgusting."

Among this year's more notable examples:
Democratic Sen. Russell Feingold of Wisconsin didn't even wait for GOP opponent Ron Johnson to win the primary. Seven weeks before Johnson officially became his opponent, Feingold aired an ad claiming Johnson would "hand over the Great Lakes to the oil companies." It showed a U.S. map, with an oil slick ominously spreading from the Gulf of Mexico to Lake Michigan.
Democratic Rep. Alan Grayson of Florida, mocking the conservative Christian beliefs of GOP challenger Dan Webster, has been calling him "Taliban Dan" on the campaign trail. Even the liberal St. Petersburg Times, calling it a “despicable” campaign tactic, said “Grayson owes Webster and his constituents an apology."

Desperate to remain her job as House speaker, Nancy Pelosi took aim at GOP rival Rep. John Boehner after he unveiled the Republican Pledge to America platform, posting a clip of him stating: "And the point we make in this preamble to our Pledge is that we're not going to be any different than we've been." Pelosi cited it as proof that "Congressional Republicans want to return to the same failed economic policies that cost us 8 million American jobs, doubled our national debt, hurt millions of Americans, and wrecked our economy." The Politifact organization called Pelosi's post a "gross mischaracterization" — Boehner clearly was referring to social issues rather than the economic policies Pelosi suggested.
The Democratic National Committee produced an ad slamming the U.S. Chamber of Commerce. It showed a thief mugging a woman in a parking garage. "They're stealing our democracy, spending millions from secret donors to elect Republicans to do their bidding in Congress," the ad stated. "It appears they've even taken secret foreign money to influence our elections." The New York Times stated flatly: "Democrats have offered no evidence that the Chamber is using foreign money to influence the elections."

President Obama attacked the Chamber as well, telling voters "groups that receive foreign money are spending huge sums to influence American elections, and they won't tell you where the money for their ads come from." The Chamber explained its accounting procedures keep foreign and domestic contributions separate. When CBS host Bob Schieffer asked White House senior adviser David Axelrod for evidence, Axelrod shot back: "Well, do you have any evidence it's not [true] Bob?" Schieffer's bemused response: "Is that the best you can do?"
In Kentucky, Democrat Jack Conway infuriated conservative Rand Paul by charging Paul worshipped a false idol called "Aqua Buddha," and belonged to an anti-Christian group, while attending Baylor University. The charge was based on an anonymous source, who told GQ magazine that Paul was involved in a college prank 30 years ago. Paul refused to shake Conway's hand after an Oct. 17 debate, saying his opponent had called his faith into question.
The Obama administration widely attacked Republican strategists Karl Rove and Ed Gillespie for the activities of the independent groups American Crossroads and Crossroads GPS. This despite the fact that Rove and Gillespie have no control over the groups, and only act as informal, unpaid advisers. It appears the strategy backfired: Some $13 million have flooded into the groups' coffers since the presidential broadsides began.

Senate Majority Leader Harry Reid has done everything but suggest that GOP challenger Sharron Angle wears a tinfoil cap to block alien transmissions. Immediately after Angle won the GOP primary, a Reid ad claimed she supported a Church of Scientology rehabilitation program for women prisoners. FactCheck.org has reported Angle never introduced that legislation, however. Reid's tactic appeared to flop with many voters after Angle handled herself well in a debate, telling him to "man up" and face the looming Social Security crisis head on.

California’s gubernatorial race has been one of the nastiest in the nation. Supporters of Democrat Jerry Brown did some dirt digging on Republican Meg Whitman, locating her former housekeeper. The investigators got the housekeeper to admit she was an undocumented worker employed by Whitman and at a teary eyed press conference claimed that Whitman has bullied her. To add icing on the cake, celebrity lawyer Gloria Allred went after Whitman, representing the former domestic.

Meanwhile, someone in Brown's campaign was recorded calling former eBay CEO Whitman, a "whore." Whitman's spokesman called it "an appalling and unforgivable smear.” In their subsequent debate, Brown apologized awkwardly, while disagreeing that being called a "whore" is as offensive to women as use of the "N-word" is to African-Americans.

In Florida's House District 22 race, the state Democratic Party distributed thousands of mailers featuring a copy of an old tax lien Republican Allen West had paid off. But the campaign piece displayed West's Social Security number, forcing West to purchase identity-theft protection for himself and his family. A Democratic spokesman issued a backhanded apology, telling The Palm Beach Post: “In order to stop the crazy West accusations, we will pay for identify-theft monitoring for the next two years.” West refused that offer, and rolled out an ad calling Democratic opponent Ron Klein a “desperate politician," adding, "It makes you wonder what else Klein will do to me, or to you.”

It seems political dirty tricks have gone high-tech this year. A hacker recently brought down the grass-roots FreedomWorks' site for two hours, just as a major fundraiser with Fox News host Glenn Beck got under way. FreedomWorks officials blasted the denial-of-service attack as a "criminal act," and estimated it cost the group over $40,000 in donations. Publicity over the attack helped FreedomWorks make up lost ground, however. Within 48 hours of the attack it had raised $161,000 of the $200,000 it needs to mount a final grass-roots push in the closing days of the campaign.

The worst-ad award may go to a group called Latinos for Reform. It targets Hispanics in Nevada, complaining of Democrats' broken promises. But the ad urges Hispanics in both English and Spanish to stay home on Election Day. "Don't vote this November. This is the only way to send them a clear message: You can no longer take us for granted. Don't vote." Hispanic organizations are blasting the ad as a blatant attempt at voter suppression.
Of course, rough-and-tumble rhetoric is nothing new to American politics.

Thomas Jefferson once paid a writer to imply John Adams was a hermaphrodite. Davy Crockett accused Martin Van Buren of wearing women’s underwear, writing he was "laced up in corsets such as women in town wear." And James Buchanan, who suffered from a congenital palsy that made his head tilt to the left, endured opponents accusations that he had tried to hang himself.

Dems take in twice as much “foreign” money as Republicans
October 18, 2010 by Ed Morrissey
Over the weekend, some Democrats began questioning the White House strategy of demonizing third-party groups for potentially using foreign-raised money in political messaging. Now we know why. Apparently, the shrieking over foreign influence was yet another case of projection:
Democratic leaders in the House and Senate criticizing GOP groups for allegedly funneling foreign money into campaign ads have seen their party raise more than $1 million from political action committees affiliated with foreign companies.

House and Senate Democrats have received approximately $1.02 million this cycle from such PACs, according to an analysis compiled for The Hill by the Center for Responsive Politics. House and Senate GOP leaders have taken almost $510,000 from PACs on the same list.

This isn’t illegal. The money comes from American employees of the foreign corporations. But the companies control the PACs, and their contributions to political parties and campaigns “is about as close as you can get” to foreign-based money flowing into campaigns, as the Center for Responsive Politics notes.

Those who got held out as examples by Democrats of potential agents of foreign influence aren’t shy about pointing out the obvious, either: “Barack Obama criticized the Supreme Court and his adversaries over the bogus charge of foreign money tainting elections – while leaders in his own party had taken more than a million dollars from the foreign cookie jar,” said Jonathan Collegio, a spokesman for American Crossroads, the political group at the center of the controversy.

“The hypocrisy here is just stunning,” he said. That’s not exactly news, either.

For those legitimately concerned over foreign influence on elections, the problem exists in this structure that allows companies outside the US to create and control PACs that can contribute to American political campaigns. The fact that they raise the money from Americans does not negate the fact that the companies control the PACs and use the leverage for their own campaigning efforts. In fact, this is worse than the hypothetical (which the White House and Democrats turned into an explicit allegation without any proof whatsoever) of American PACs controlled by American citizens raising funds overseas and using them in political campaigns.
Perhaps the White House didn’t want to focus on the real problem and decided to use a fake problem for misdirection.

Democrats-in-Desperation-Mode
"win it outright"
By Jon Ralston · October 26, 2010

As Sharron Angle's campaign attorney, I am sorry to report that the Democrats and their cronies are up to their same old tricks, of trying to manipulate the election in hopes of skewing the results in their favor.

Two days ago, the Democratic Secretary of State announced that voters can be provided "free food" at "voter turnout events." Harry Reid has been offering free food and, according to other reports, some Democratic allies such as teachers' unions are offering gift cards in return for a vote for Reid.

Before we were even able to document the reported infractions to report to the authorities, the Democrat Secretary of State slammed the door shut on preventing this behavior and issued a public statement permitting these ACORN-style tactics. THESE are the kinds of shenanigans that can turn this race.

Harry Reid intends to steal this election if he can't win it outright. As a result, we need to deploy literally dozens of election law attorneys and poll watchers to combat these tactics at a cost of nearly $80,000. That's over and above our current budget. We need to raise $80,000 and we need to do it RIGHT NOW, because even as I am writing this, Harry Reid and his Machine are trying to steal this election. I'm sorry that we have to come to you yet again and ask for you to reach deep and contribute, but we must.

Understand, EVERYTHING we have worked for in the last year could be destroyed by dirty tricks and criminal acts in the next 8 days. As Sharron's first line of defense on these matters I am absolutely committed to making sure this won't happen.

What Harry Reid is doing is clearly illegal. Nevada law (NRS 293.700) provides that, “A person who bribes, offers to bribe, or use and other corrupt means, directly or indirectly, to influence any elector in giving his or her vote or to deter the elector from giving it is guilty of a category D felony and shall be punished as provided in NRS 193.130.”

We've seen evidence of this sort of voter 'enticement' by groups such as ACORN - where, in 2008, two ACORN workers in Milwaukee were accused of offering pre-paid gasoline cards or restaurant gift cards to people in exchange for registration.

John Fund wrote in his book Stealing Elections: How Voter Fraud Threatens Our Democracy, cited reports from the Sioux Falls Argus-Leader (South Dakota) and the election in 2004, where certain residents were quoted saying that "people on the streets were saying you go vote, they would give you gas money, $10, maybe a pack of cigarettes..."

Now, this week in Las Vegas, at our election hotline, we received reports that some teachers' union representatives were offering Starbucks cards to people to get them to vote for Harry Reid. It is even more disturbing and may be possible that they are using their influence and authority as educators to entice students on behalf of Reid.

Here’s the bottom line: when the powerful are threatened, they will do anything to retain their position. It's clear now that Harry Reid's campaign is even willing to skirt the laws of Nevada to do it.

Is there any question that they will do the same on Election Day?

Will you help us raise this $80,000 today? With it we can fight the election-stealing tactics of Harry Reid and his corrupt cronies.

The right to vote is a precious one - and it carries with it somber responsibilities. The Democrats' willingness to allow voters to be enticed with a promise of any thing of value is a debasement of the process- and it may just destroy everything we've worked for.

Please send an urgent contribution so our work will not be in vain. We’re going to win this race as long as we don’t let Harry Reid steal it. Can you help us today?

Sincerely,
Cleta Mitchell

Dept. of dirty tricks - Ben Smith: Dept. of dirty tricks October 27, 2010
For all the talk of "dirty tricks," Kasie Hunt today gets at something that is pretty tricky:

With just six days left until Election Day, a key component of the Democratic strategy to hold the House is becoming clear: In more than a dozen close races, Democrats are encouraging and advancing little-known, conservative third-party candidates in an attempt to fracture the Republican vote enough to eke out narrow victories.

Behind-the-scenes collaboration between local Democratic officials and tea party activists in a handful of isolated races has already been reported — just last week, in suburban Pennsylvania’s open 7th District, Democratic nominee Bryan Lentz finally admitted his campaign’s role in helping a tea party candidate get on the November ballot after months of avoiding the question.

But the divide-and-conquer strategy has become more widespread — and coordinated — through television ads, robocalls and mailers in recent weeks as races have tightened and it’s become more apparent that just a few percentage points could end up swinging the outcome in many races

Dirty Tricks – Democrats In Desperation Mode
By TVC Executive Director Andrea Lafferty

Democrats believe that if you can't win fairly on the issues, then resort to gutter politics, smears and underhanded tactics to defeat Republican candidates.

A week ago, Obamunist operative David Axelrod charged that the Chamber of Commerce was receiving donations from foreign sources in violation of federal law. Axelrod had not one shred of evidence that this is true, but he made the talk shows to smear the Chamber.

Axelrod should be grilled about the estimated $63 million or more that flowed from foreign sources into Obama's campaign coffers in 2008. Was he troubled by those donations? More than half of Obama's donations were under $200 and he refused to release donor names. (Pam Geller of Atlas Shrugs analyzed Obama's questionable overseas donations.)

Would Axelrod object if we accused him of being a grave robber and asked him to prove he wasn't? He's done the same thing to the Chamber of Commerce, but clearly has no shame about it.

Many Democrat candidates are also shedding any sense of decency by claiming their opponents are for the slaughter of puppies, are tools of "Big Oil" or are Christian versions of the Taliban. Florida Democrat Alan Grayson is one of the worst offenders.

The latest dirty trick is being engineered by Chris Bowers, the campaign director for Daily Kos (the rabidly leftist web site). Bowers has launched a campaign against 98 House Republicans by capitalizing on the Google search habits of voters. Bowers wants his leftist friends to blog on any negative stories about these Republicans in order to influence the search results on Google. The goal is to target undecided voters who may be searching for background information on Republican candidates. Bowers launched a similar Google Bomb campaign in 2006. During that sleazy campaign, he had linked specific candidates to such keywords as "miserable failure."

Queen Of Dirty Tricks: Shauna Daly
Shauna Daly operates in the shadows, but her influence will be felt everywhere during this election season. Who is she? She's the Director of Research for the Democratic National Committee and she's got the well-earned reputation as being a "dirty trickster" for liberal candidates and causes.

Daly was hired by the Obama Administration back in February 2009 to work with White House Counsel Greg Craig. She had no legal experience, but had plenty of experience as an opposition researcher – digging up dirt on political opponents of Democrat candidates.

Daly has worked for Sen. Tim Johnson (D-SD), Betty Castor of Florida and worked on John Edwards' presidential campaign. In 2005, she was working with the DNC to find dirt on Mitt Romney. She was also trying to get dirt on 10 other potential candidates for the Republican nomination for president in 2008.

Interestingly enough, Daly only spent a little more than a month working in the White House Counsel's office before returning to the DNC. It appears she may have been there to collect as much intelligence as she could on Bush officials before going back to the DNC.

During this time, she had unprecedented access to all sorts of sensitive documents. According to the American Spectator:

Military Votes Not Counted 98,000 Lost Military Ballots

Military Votes Not Counted: 98,000 Lost Military Ballots
By Maggie M. Thorton

Six million American citizens abroad were qualified to vote in the 2008 Presidential election. It is estimated that one-fourth of all military votes were not counted. At least, 98,000 lost military ballots were mailed back to the U.S. but not counted. http://military.rightpundits.com/2009/05/13/military-votes-not-counted-98000-lost-military-ballots/
In the time I began writing this report, the details have changed. Fox News said this morning that one-fourth of military votes were not counted – that’s one out of four votes uncounted. A few minutes later, that estimate was raised to possibly one third of all military votes went uncounted – 1 out of 3 votes uncounted. Active duty and reserve troops make-up the largest portion of ballots received by eligible voters abroad. Some 441,000 ballots were requested. Of those, 98,000 were “lost.”

It is unclear from the major new sources, whether 98,000 ballots were mailed overseas and are considered “lost” because voters abroad decided not to exercise their vote, or if the 98,000 were “mailed out,” meaning mailed to the U.S. from abroad, and known not to have been received by election officials. From reporting, it appears the ballots are lost. Here’s the exact wording:

It said that of 441,000 absentee ballots requested by eligible voters living abroad — mainly active-duty and reserve troops — more than 98,000 were “lost” ballots that were mailed out but never received by election officials.

According to Senator Chuck Schumer (D-NY), voter negligence is not thought to be a major factor in the lost military ballots. Schumer has announced an investigation. Schumer is quoted as saying “there is a chronic problem of military voters being sent a ballot without sufficient time to complete it and send it back. “It is reported that 11,000 ballots were “returned as undeliverable,” and 13,500 ballots were rejected for missing signatures, or the required notarization.

Maybe there is a problem mailing in ballots, and maybe there is not. Read this report from Military.com: Maj. Gen. Jeffrey Schloesser, the top commander of U.S. forces in Afghanistan, said in October: the U.S. military has made a big push this year to help Soldiers request ballots, advertising the process with TV commercials, posters and ballot drives outside dining halls and recreations centers.

The top commander of U.S. forces in Afghanistan, Maj. Gen. Jeffrey Schloesser, said he thinks this year’s effort was “the most significant drive probably in our nation’s history” to make sure deployed Soldiers can vote.

Schloesser said that in previous years deployed forces feared their vote would not count, but he said he hasn’t seen reason to believe votes wouldn’t count this election cycle.

At the main U.S. base at Bagram on Wednesday, Soldiers and civilian contractors filled out ballots known as the Federal Write-In Absentee Ballot. Those ballots are used when a person who has requested an absentee ballot has not received one.

From this same report: Democrats Abroad, the official Democratic Party organization for Americans living outside the United States, opened a new chapter in Afghanistan this autumn and helped dozens of Americans request ballots, said Susan Marx, the group’s chairwoman.

So it appears that a vote can be cast even if you have not received a requested ballot. And it seems that Democrats are over there helping soldiers vote. Are there any Republicans doing the same? Maybe votes are not being counted because they are military votes. Yes, I’m cynical.

There are so many infuriating details about this story. We go through this each election, and Congress postures and puffs and sweeps the details under the rug.

Some questions:

1) If “returned as undeliverable” is an issue, why not give our busy military a break and print the return address on the envelope? I don’t think our troops have the Yellow Pages over there. I understand that these votes go to differing precincts, but in this high-tech era, we can supply the return address for each vote.

2) Why are the ballots getting out too late to be returned in time for the vote count? There can be no excuse for this, with the possible exception that “government workers” are in charge.

3) Will we ever again trust our government to hold our votes sacred?

4) Where are the Senate’s war heroes: John McCain, John Kerry and Bob Dole? Years in the Senate and our military votes are still disenfranchised?

While American soldiers standby nearby to protect the lives of Iraqi’s casting a vote, their own vote gets shoveled.

Senator Chuck Schumer has vowed to investigate. Fox News’ Steve Centani is reporting that hearings are underway now on Capitol Hill. Whatever. What a disgrace for this country: military votes uncounted! 98,000 lost military votes!

Democrats play dirty tricks in Pennsylvania

Residents cry foul over ballots
By: PETER HALL
Bucks County Courier Times
A petition was filed with the Board of Elections over absentee ballots.

VOTE REPUBLICAN - Save our Country!
A trio of Bucks County residents backed by the county Republican committee say they have evidence linking Democratic Congressman Patrick Murphy's campaign to a scheme to flood the county voter registration office with fraudulent applications for absentee ballots.
http://www.phillyburbs.com/news/news_details/article/28/2010/october/27/residents-cry-foul-over-ballots.html
In a petition filed Tuesday, county Republicans say the name of Murphy's campaign manager appeared on a Bristol post office box where voters were urged in a series of letters paid for by the state Democratic Committee to send absentee ballot applications.

The county Republicans submitted with the petition a photograph of a note inside the mailbox that said, "Tim Percico and Paul Hampel only pick up mail." Tim Persico is Murphy's campaign manager, although his name is misspelled in the note. Hampel is a volunteer for the Democratic state committee who said he collects mail from the box.

While county and state Democratic officials denied involvement in the letter campaign or refused to discuss it, Persico said Tuesday that the "PA Vote 2010" project that paid for the letters is a partnership between Murphy's campaign and the state Democrats.

Persico said the goal of the project is to help eligible Democratic voters obtain and cast absentee ballots.

He dismissed assertions by Republican critics that the letters were misleadingly worded and noted that the Democratic state committee clearly takes credit for the mailings, which comply with all election laws.

"The only reason the Republican Party is mad is working parents and college kids are sending in an application because they want to vote," Persico said.

Neither Murphy nor a spokeswoman for his campaign returned calls Tuesday.

Bucks County Democratic Party Chairman John Cordisco said the county Democratic organization has no connection to the letters or the fraud alleged in the petition. "If there was voter registration fraud, it was being done outside the Democratic organization," Cordisco said.

In response to the Republican petition, the Bucks County Board of Elections scheduled a hearing 9:30 a.m. Friday at the courthouse to hear evidence of what the Republicans characterize as a coordinated effort to trick voters into improperly applying for absentee ballots and efforts to submit fraudulent applications for absentee ballots.

"While some of these invalid applications have been caught and rejected by the Board of Elections, we believe many other defective and objectionable applications were inadvertently approved by the Board of Elections due to the pervasive nature of the fraud," the petition says.

The petition also asks county election officials to secure all completed absentee ballots at the courthouse in Doylestown until the board of elections can conduct an investigation of the claims.

The petition is signed by Kelly McGinty of Middletown, and Carlo and Lucy Grilletto of Plumstead. Bucks County Republican Party Vice Chairwoman Pat Poprik said party officials and volunteers have gathered evidence in support of the claims put forth in the petition. The signatories are people who have been involved in the Republican Party, she said.

"They're a group of people who are just disgusted with what's been going on," Poprik said. "God bless them, they came forward to do something about it."

The petition is the latest in a series of alarms county and state Republicans have sounded over an influx of questionable absentee ballot applications. Last week, Bucks County District Attorney David Heckler said his office would investigate allegations of fraud leveled by state and county Republican officials.

Voter Registration Director Deena Dean said her staff had rejected more than 600 defective absentee ballot applications as of Friday. Although the voter registration office continued to accept applications until the close of business Tuesday, Dean was unable to provide an updated total.

The petition focused foremost on a series of letters voters in Bucks County began receiving some time after Labor Day. On letterhead of the fictitious Pennsylvania Voter Assistance Office, the mailings warned recipients that their right to participate in the Nov. 2 election might be in jeopardy if they failed to respond.

Advertisement The letters are signed by Frank S. Schultz, a Levittown resident who contributed $2,750 to Murphy's 2008 campaign, according to Federal Election Commission records.

The letters included an absentee ballot application and a postage-paid envelope addressed to post office box 2172 at the Bristol Borough post office on Beaver Street. The petition includes a photo in which the note containing Persico's name is visible through the window of the post office box.

"The bogus letter seeks to trick voters into needlessly registering for absentee ballots and then, for reasons unknown, causes them to send those ballots to a post office box apparently controlled by the Democratic candidate for Congress," the petition says.

Poprik said the photograph was taken Monday by a volunteer for the county Republican committee who she declined to name. The photograph bears a date stamp of "08/06/2009," which Poprik said was the result of the camera being improperly set up.

"The applications then appear to be sent to a central processing location to be gathered, screened and held, as evidenced by the fact that the dates on numerous applications are dated several weeks before the application were received in the Board of Elections," the petition says.

Persico said the purpose of collecting the applications at a central location is to track who applied and ensure that they have received their ballots.

The petition also cites a widely circulated e-mail from the Murphy campaign that encourages affiliates to gather absentee ballot applications from infrequent voters.

Six Bucks County residents provided affidavits included in the petition in which they describe encounters with campaign workers who instructed them to complete absentee ballot applications when they did not plan to be out of town for the election or to sign the names of family members to obtain ballots for them.

One woman said that she received the Pennsylvania Voter Assistance Office letters and discarded them. "Nonetheless an absentee ballot was submitted in her name," the petition says.

Finally, the petition says the volume of rejected ballot applications suggests that additional incomplete and fraudulent applications have inadvertently passed through the board of elections screening process.

"More time is needed to test the veracity and reliability of those ballots already submitted to the Board of Elections," the petition says.

Bucks County Commissioner Chairman Charley Martin, who also chairs the board of elections, said he consulted the board's solicitor and believes that a hearing to consider the petitioners' evidence is appropriate.

Martin said the board will hear the evidence and take action to address any problems within its power.

"If it is not in the bailiwick of the board of elections then it will be for the district attorney to consider," Martin said.

Commissioner Diane Ellis-Marseglia, who is also a member of the board of elections, said she has questions whether the board of elections has authority under the election code to consider problems with absentee ballot applications. Marseglia also said she is not worried about the integrity of absentee ballots themselves.

Marseglia added that the controversy over absentee ballots involves two distinct issues - the matter of the misleading Democratic state committee letters and the question of whether forged applications are being submitted.

"I don't think the board of elections has any responsibility to deal with a political piece," she said. "We have a responsibility to deal with absentee ballots."

Murphy's Republican opponent Mike Fitzpatrick called the allegations very serious. He noted that he took an interest in the rejected ballot applications last week, but said the county Republican party has done all of the investigating.

"I think the allegations are very serious and the potential fraud upon the voters of this county is substantial," Fitzpatrick said.

Obama Heads to Asia, Breaks Foreign Travel Record
Posted by Mark Knoller
...Foreign travel by American presidents is a relatively new practice. No sitting U.S. president left the country until Theodore Roosevelt in 1906. He made a single foreign outing: a 3-day visit to Panama in November of that year to inspect construction of the Panama Canal.

On to India....
It's understandable that Obama wants to be on the other side of the world when results from the mid-term elections are being realized. But, in a time of hardship for so many Americans, one can only onder what the extravagance of his November 6th trip to India will cost. Here are a few highlights:

- The President has booked all 570 rooms, banquet rooms, and restaurants at the 5 start Taj Mahal hotel.

- In addition to the Taj Mahal Hotel, 125 rooms at the Taj President, and 80 to 90 rooms at each the Grand Hyatt and Oberoi Hotels have been booked for his additional entourage.

- In addition to Air force one, two jumbo jets and military figher escorts will be usd to ferry his staff.

- 45 cars will be used in his motorcade.

- Because the Taj Mahal Hotel is seasde, the U.S. Navy will be patrolling the waters out to 330 km off the coast.

- The administration has booked the entire India National Center for the Performing Arts to meet with business leaders.

- The security detail will be HUGE.

- Michelle is going to meet with 'commercial sex workers'. Why, I don't know. But the additional cost of her security to enter th seediest areas of Mumbai must be quite a bit.

- The distruption of life and traffic in Mumbai will cost the locals plenty.

Read the article from the Economic Times here:

"US President Barack Obama and First Lady Michelle will be extremely busy in Mumbai, upon landing on November 6 for a two day India visit. As the world’s most powerful man and his wife zip around the city visiting the 26/11 memorial on Marine Drive, the National Centre for Performing Arts (NCPA), Mani Bhawan and other locations in south Mumbai, the security obviously will be water-tight .

Adding to the Obamas’ busy schedule is Michelle’s likely visit to Kamathipura, where she will meet commercial sex workers on the invitation of an NGO. The highprofile visit is likely to inconvenience the citizens, as there could be a complete clampdown on traffic on some main roads of south Mumbai and sanitisation of buildings flanking them.
The Obamas will stay at the Taj Mahal Hotel, and his itinerary practically means Marine Drive will be shut for vehicular traffic on the day of the President’s visit, while buildings flanking it will be sanitised with security personnel manning them until Obama has left the place. Same would be the case with Obama’s visit to Mani Bhawan and Michelle going to Kamathipura.

An officer with the security establishment said, “Several other arterial roads in south Mumbai will also see restricted traffic movement, with tight security all around. The Obamas are not expected to schedule any engagements in the night due to security reasons.”

Since Obama is expected to arrive in the afternoon on November 6, and will travel by road to the Taj Mahal Hotel, the entire stretch from airport to the hotel will be under heavy security. The officer said, “There will be no vehicular movement on Western Express Highway at that time. Traffic on roads leading up to the highway will also be stopped. All buildings flanking the entire stretch will be sanitised. However, there is no threat from the snipers as the President will travel in a bullet-proof car with 4.5-inch thick sheets, which are impenetrable for any gun.”
Obama’s personal security staff itself will be huge, and it has already started making its own arrangements in Mumbai. “A team of secret service agents has already arrived, and has surveyed the areas of his stay and the roads and places on his itinerary,” the officer said.

To ensure fool-proof security, the President’s team has booked the entire the Taj Mahal Hotel, including 570 rooms, all banquets and restaurants. Since his security contingent and staff will comprise a huge number, 125 rooms at Taj President have also been booked, apart from 80 to 90 rooms each in Grand Hyatt and The Oberoi hotels. The NCPA, where the President is expected to meet representatives from the business community, has also been entirely booked.
The officer said, “Obama’s contingent is huge. There are two jumbo jets coming along with Air Force One, which will be flanked by security jets. There will be 30 to 40 secret service agents, who will arrive before him. The President’s convoy has 45 cars, including the Lincoln Continental in which the President travels.”

Since Obama will stay in a hotel that is on sea front, elaborate coastal security arrangements have been made by the US Navy in consonance with the Indian Navy and the Coast Guard. “There will be US naval ships, along with Indian vessels , patrolling the sea till about 330-km from the shore. This is to negate the possibility of a missile being fired from a distance,” the officer said.

The President will be accompanied by his chefs, not because he would not like to savour Indian cuisine, but to ensure his food is not spiked.

US President Barack Obama and First Lady Michelle Obama are scheduled to land in Mumbai on November 6."

President Obama has spent all or part of 26 days "on vacation" during his first year as president, according to CBS News White House Correspondent Mark Knoller.

Knoller, who has covered every president since Gerald Ford and is known for keeping detailed records on presidential travel, counts the following among President Obama’s "vacations" in 2009:

■A four-day holiday weekend in Chicago in February where the president played some basketball and treated First Lady Michelle Obama to a Valentine’s Day dinner date.
■An eight-day stay with his family at a rented house on Martha’s Vineyard in August.
■ A trip out west to the U.S. states of Montana, Wyoming, Colorado and Arizona that combined both business and pleasure. The president held town hall meetings on health care during the trip. And he went fly fishing and took trips to Yellowstone National Park and the Grand Canyon with his wife and two daughters.
■An 11-day stay in Hawaii where the president and his family celebrated Christmas and New Year’s Eve.

Obama Has Shot 41 Rounds of Golf as President
by Keith Koffler on July 16, 2010, 3:30 pm

President Barack Obama has played a remarkable 41 rounds of golf since becoming president, easily outpacing his predecessor and possibly damaging his ability to portray himself in 2012 as a populist advocate of average folks.

With the excursions lasting on average at least five hours, the president has devoted a total of more than 200 hours to golf, not counting time spent on the White House putting green. That’s the equivalent of twenty five eight-hour work days, or five work weeks spent smacking golf balls.

The former community organizer’s 41 trips around the links – a standard of recreational activity well beyond the budgets of most Americans – compares to only 24 total outings for former President George W. Bush, according to statistics compiled by White House chronicler Mark Knoller of CBS News. Bush, whose golf outings were used to help deride him as a callow, lazy, rich boy, played his 24th and last round on Oct. 13, 2003, saying he was ending the practice out of respect for the families of Americans killed in Iraq.

Since the April 20 explosion that killed 11 rig workers and started the Gulf oil spill, Obama has teed up seven times, according to White House Dossier’s count. This includes back to back sessions April 23 and 24 while on vacation at the Grove Park Resort & Spa in Asheville, NC, just days after the crisis began.

Obama’s focus on golf borders on obsession. Startled reporters follow him out to the course in the motorcade in the broiling Washington heat and then wait in the air conditioning while he puts in 18 holes. Rarely does he play any less.

On June 19, he dragged the 67 year old Vice President Biden onto the course for a sweltering 18 holes, calling into question whether he was trying to commit murder-by-golf in order to free the 2012 VP slot up for Hillary.

From a period stretching from April 3 to May 22 of this year, the president went golfing eight of nine weekends. WOULD YOUR WIFE LET YOU DO THAT?? WOULD YOU LET YOUR HUSBAND? Michelle, what gives?

He went out only once in June when, with the Gulf of Mexico slowly becoming the new U.S. Strategic Petroleum Reserve and accusations of presidential inattention at their height, White House image counselors appeared to think the golf needed scaling back. But he’s back with a vengeance, having made his way out on the course both weekends so far this month.

Since he’s officially on vacation this weekend in Bar Harbor Maine, there appears to be little holding him back from heading out to the greens at least once.

While on the course, Obama for the most part likes to keep it nice and light, often playing with a youngish crowd. No deep discussions of policy on the links.

One of his companions on nearly every outing is Marvin Nicholson, the affable, White House trip director. Nicholson, a former “body man” to Sen. John Kerry (D-Mass.), is the perfect guy for getting away from it all, having worked as a golf caddy, a bartender, and in a windsurfing shop – where he met Kerry.

Also generally on hand is David Katz, a former Obama campaign photographer.

Emphatically not invited for the most part are members of Congress or senior White House aides.

The White House is of course sensitive to the awkward look of the whole thing. A search of of the word “golf” on the White House page or the photo sharing site Flickr brings back only nine official White House photo results, three of which are neither of Obama nor golf. A search for “basketball,” the everyman’s game, brings back 39 photos.

But who wants to be the White House official to tell the president to cut back on golf? Somebody with another job offer, one would presume.

Attention all housewives Obama has taken away your Flexible Spending Account Now YOU MUST HAVE A PRESCRIPTION

Effective January 1, 2011 over-the-counter (OTC) medications and drugs without a prescription will not be reimbursable through the healthcare FSA. Other OTC items such as bandages and contact lens solution are still eligible. OTC produces such as cold medicines, aspirins, etc., will not be reimbursable under the FSA plan on or after January 1, 2011.

insuranceHow health care reform changes FSAs, HSAs
By Claes Bell • Bankrate.com
HighlightsFSAs allow employees to sock away tax-free dollars for medical expenses.
Starting Jan. 1, 2013, FSAs will have annual limits of $2,500 per year.
Tax-free contributions to HSAs and Archer MSAs will still be unlimited.

If you pay for medical care out of a tax-advantaged account such as a health savings account or flexible spending account, passage of the new health care reform law might make these so-called cafeteria plan benefits such as FSAs and HSAs a little less tasty when it comes tax time.

The new law reduces the amount of money you can contribute to these accounts and shelter from Uncle Sam's reach. It also creates stricter rules about how the dollars you put away can be used. These new rules and penalties are designed to generate revenue to offset the cost of the health care reform law's health insurance tax credits and other spending.

Cafeteria plans are so named because they allow employees to choose from a list of benefit options much like a cafeteria menu. Among those options are health care spending accounts.

Flexible spending accounts, or FSAs, allow employees to sock away tax-free dollars that can be used to pay for medical expenses such as drug co-pays, deductibles and treatments not covered by insurance plans. Up until now, there hasn't been an official limit to how much you could contribute to an FSA, although IRS rules dictated that employers create some kind of maximum contribution. Many employers cap the amount in the $2,000 to $5,000 range according to a 2009 report by the Center on Budget and Policy Priorities in Washington, D.C.

Starting Jan. 1, 2013, FSAs will have annual limits of $2,500 per year. Going forward, the limit will rise annually based on the rate of inflation. Still, it likely will remain above the average employee contribution, which was $1,424 in 2009, according to Mercer's National Survey of Employer-Sponsored Health Plans, an annual report on health care benefits.

In addition, FSAs will remain "use-it-or-lose-it" accounts. That is, any unused balance for one year can't be used to fund health care spending in the next year.

New restrictions on how you can spend FSA funds will change more quickly. Starting Jan. 1, 2011, you won't be able to spend FSA dollars on over-the-counter medical supplies that aren't specifically prescribed by a doctor, putting a damper on the annual ritual of FSA holders trying to spend unused funds by stocking up on their favorite over-the-counter medicines.

Despite the new limits, the law isn't intended to discourage the use of FSAs, says Sara Collins, vice president for the Affordable Health Insurance Program at The Commonwealth Fund, a health care research foundation in New York.

"It's designed to bring some balance back into the tax code and make sure those dollars are used for medical purposes," says Collins. "You can still put money aside in these accounts, there just won't be quite as big of a tax break."

Health savings accounts, or HSAs, also are getting new limits and restrictions. HSAs allow employees who have a high income or who are in good health to save part of their earnings tax-free and use the savings to pay most of their medical care out of pocket. Unlike FSAs, which are meant to supplement a typical health insurance plan, HSAs are paired with a "catastrophic" insurance policy that kicks in once the high annual deductible has been paid.

Also unlike FSAs, HSA balances roll over from year to year, allowing participants to save for health care costs and even for long-term care later. Because of the new health care reform law, HSA funds can no longer be used to buy over-the-counter drugs without a doctor's prescription. Those who withdraw HSA funds for nonmedical purposes will see their tax penalty double, from 10 percent to 20 percent of the total withdrawal, starting Jan. 1, 2011.

The Archer Medical Savings Account, the small-business version of an HSA known as an Archer MSA, will see similar restrictions, with the only difference being the Archer MSA's penalty for nonmedical withdrawals now stands at 15 percent and will go up to 20 percent. Archer MSAs also will have restrictions on buying over-the-counter drugs without a prescription starting Jan. 1, 2011.

The HSA's cafeteria plan cousin, the health reimbursement account, known as an HRA, is also affected by the new law. HRAs work similarly to HSAs, but instead of being funded by employee contributions, HRAs are funded by the employer. HRAs will get the same restrictions on over-the-counter medicine.

On the bright side, tax-free contributions to HSAs and Archer MSAs won't be affected. And with far-reaching reform set to transform health care by 2020, it might be comforting for HSA holders to know that the HSA/high deductible model isn't going anywhere.

In fact, legislators looked to the high-deductible insurance plans typically packaged with HSAs today as a template for the minimum coverage that will be available on state insurance exchanges once they're up and running in 2014.

"The floor for health insurance plans under the new law will be similar to the insurance plans that are now HSA compliant," says Collins.

Changes to the Childcare Vouchers Salary Sacrifice Scheme
■What's going to change?
■What does this change mean for you?
■What do you need to do?
■A few more facts and figures
■Any questions?

What's going to change?
• Until 5 April 2011, all childcare voucher scheme members will receive tax and National Insurance relief on up to £55 per week (£243 a month) of childcare vouchers.

• Higher-rate taxpayers who sign up for childcare vouchers after 5 April 2011 will only receive tax and National Insurance relief on up to £28 per week (£124 a month) of childcare vouchers.

• Parents who pay 40% tax can currenlty save up to £1,196 a year by using childcare vouchers. The savings will fall to £608 a year for higher-rate taxpayers who sign up after April 2011.

What does this change mean for you?
If you are basic-rate taxpayer:

• As long as you continue to be a basic-rate taxpayer, the change will not affect the savings you receive from childcare vouchers.

• If you have a break from childcare vouchers or if you move to a new employer after April 2011, your earnings will be assessed when you re-order your vouchers and at the start of each new tax year. If you subsequently become a higher-rate taxpayer, the new rules will apply.

• If you stay with your current employer and you continue to order childcare vouchers with no breaks, then the new rules will not apply to you even if you become a higher-rate taxpayer.

• If you are not sure whether you will become a higher-rate taxpayer in future, we recommend that you avoid taking any breaks from childcare vouchers and instead maintain a continuous voucher order.

If you are a higher-rate taxpayer:

• If you sign up for childcare vouchers after 5 April 2011, you will only be entitled to tax and National Insurance relief on up to £28 a week of childcare vouchers.

• If you are currently receiving childcare vouchers but have a break in your voucher order, the new rules are likely to apply if you rejoin the scheme after April 2011.

• If you move to a new employer after April 2011, you will be treated as new member and the new rules will apply to you.

What do you need to do?
• If you are not currently using childcare vouchers but you expect to pay for childcare in future, sign up before 5th April 2011 to protect your voucher entitlement.

• We recommend that you start receiving childcare vouchers no later than March 2011, to make it easier to demonstrate that your scheme membership started before 5th April 2011.

• If you are already using childcare vouchers and you currently opt in and out of the scheme, for example to cover school holiday childcare, we recommend that you maintain a continuous voucher order of at least £10 a month rather than opting in and out.

• You don’t need to spend your childcare vouchers as soon as you receive them – any unused vouchers will stay in your KiddiVouchers account for future use. Refunds are not always possible, so please only order vouchers which you expect to be able to spend.

A few more facts and figures
• If you join the scheme after 5th April 2011, you will need to have your earnings estimated when you join the scheme and at the start of each future tax year. Your childcare voucher entitlement will be recalculated at the start of each tax year. If you are a basic-rate taxpayer, you will still have the earnings assessment but your childcare vouchers will not be affected.

• The earnings assessments will be based on your basic contractual pay plus any taxable benefits. Income such as overtime, bonuses or interest from savings will not be taken into account. If you pay higher-rate tax as a result of receiving overtime, bonuses or other income, you may be treated as a basic-rate taxpayer for your childcare voucher entitlement.

• If you have had an earnings assessment but your earnings then change during the tax year, your childcare voucher allowance will only be recalculated at the start of the next tax year.

• If you are a 50% taxpayer, your childcare voucher allowance will be capped at £22 a week (£98 a month) unless you join the scheme before 5th April 2011.

• If you are expecting a baby after April 2011, unfortunately you cannot sign up for childcare vouchers until your baby has been born.

• If you have recently had a baby but you are not expecting to need childcare until after April 2011, you can order childcare vouchers now and spend them later.
